Cruz Marcelo & Tenefrancia Senior Partner Miguel U. Silos’ Doctrinal Work on the Abandonment of the Condonation Doctrine Featured in the Philippine Law Journal

The Philippine Law Journal (“PLJ”), the oldest English-language law review in Asia, recently revisited the seminal work of Cruz Marcelo & Tenefrancia Senior Partner Miguel U. Silos, Head of the Firm’s Litigation and Dispute Resolution Department, on the abandonment of the condonation doctrine.

First published in the PLJ in 2009, Atty. Silos’ doctrinal article entitled “A Re-Examination of the Doctrine of Condonation of Public Officers” critically examined the condonation doctrine, which had long shielded elected officials from administrative liability for acts committed in prior electoral terms. His scholarship later served as a key authority in the Supreme Court’s landmark ruling in Carpio-Morales v. Court of Appeals, G.R. No. 217126 (10 November 2015), which decisively overturned the 56-year-old doctrine and reshaped Philippine jurisprudence on public accountability.

By revisiting this work in its feature, Revisiting the Condonation Doctrine, the PLJ underscored the enduring significance of Atty. Silos’ scholarship in shaping one of the most consequential doctrinal shifts in recent legal history.
