IPOPHL MANDATES THE UPFRONT PAYMENT OF ISSUANCE AND PUBLICATION FEES IN THE REQUEST FOR RENEWAL OF TRADEMARKS

In line with its efforts to streamline work processes and automate business-related transactions, the Intellectual Property Office of the Philippines (“IPOPHL”) issued Memorandum Circular No. 2024-023, which amends Rules 1200 and 1206 of IPOPHL Memorandum Circular No. 2023-001 or the Rules and Regulations on Trademarks, Service Marks, Trade Names and Marked or Stamped Containers of 2023.

The amendment mandates that the request for renewal of trademarks includes not just the payment of the renewal fee, but also the issuance and publication fees for the Renewal of Registration. Compared to the previous rules which involves a separate payment of the required fee for the issuance of the certificate of renewal, the new rules involve fewer steps, thus promoting the ease of processing the renewal of registration of trademarks.

Based on the foregoing comparison, unnecessary delay in the issuance of the Certificate of Renewal, brought about by the deferment of payment of prescribed fees for the issuance and publication cost, shall be avoided. IPOPHL Memorandum Circular No. 2024-023 will take effect on 25 July 2024.
